Feds take fuel spill case but no guarantee of charges

The Feds have – as expected- taken conduct of the Slocan Valley fuel spill case.

However there is no guarantee of charges being laid after the 2013 incident.

Federal Crown Counsel Todd Gerhart told the Nelson court Monday that he will await an investigation by the BC Conservation Office and Environment Canada before deciding whether to lay charges.

Both Executive Flight Centre (which contracted the tanker) and the Province of BC (which contracted the company ) could be charged after the vehicle fell into Lemon Creek and spilled over 30,000 litres of fuel.

Local activist Marilyn Burgoon had been granted permission by a BC judge to prosecute as a private citizen but had always called on the Feds to pursue the matter because of the pollution and contravention of the Fisheries Act.
